Amazon India’s fashion segment faced a huge set back recently when the Delhi High Court ordered the e-commerce giant to stop retailing Beverly Hills Polo Club merchandises via its Amazon Global Store on its India-centric marketplace.
International label Beverly Hills Polo Club had filed a complaint against Amazon India and Amazon Export Sales LLC (which operates through the Global Store platform of Amazon) regarding trademark violation. The allegation was that some of the retailer’s sellers were involved in widespread supply and sale of duplicate goods.
Notably, the Delhi High Court directed Amazon Export Sales LLC to share the details of its sellers who are allegedly marketing counterfeit items on Amazon’s Global Store for further sale.
Eli Haddad, Founder & Managing Director, Beverly Hills Polo Club cited that counterfeiting activities on the e-tailer have significantly hampered the label in India.
Additionally, the MD of the global apparel brand elucidated that it is visible that Amazon is abusing its dominant position in the country’s market. There ought to be check and balances under any law such that rights are not unfairly exploited. Despite the company’s constant reminder to Amazon of infringing activities, sold directly by Amazon along with third-party sellers, the e-commerce player has not put a stop to its illegal and abusive operations and actively promoted the sale of counterfeit products.
It is important to add here that, reportedly, Amazon is trying to acquire a minimal stake in India’s leading retail chain, Future Group and this decision against the online retailer can hamper the negotiations that are yet to be made official.
